JMB Sri Jasmin & BUTL

Sri Jasmin had their First Meeting of the JMB on the 30th of November 2008 after nearly 4 months of hardwork from the Pro Tem Committee of Sri Jasmin and some of the members of the BUTL Resident Association.

The Meeting was a success & 8 office bearers were elected in that First Meeting. Now, Sri Jasmin is looking for all the lost purchasers of Sri Jasmin. i.e. Those who have changed contact no., jobs & addresses. Sri Jasmin is currently doing some face lifts for their webblog that has also seen them changed name from ptc to jmb. Hence, their webblog is now http://srijasminjmb.blogspot.com where you can even view who the office bearers are along with the positions they hold as well as the JMB Certificate issued by MPN.

While Sri Palma Villa 1, 2, 3 & 6 and Sri Jasmin have their own JMB, these 2 development area will need all the rest of the 13 development areas to have a JMB and to live, breathe & speak with 1 voice. That is the only way we (the purchasers of BUTL) can have our investment salvaged. Good management & marketing will be the savior because the bank loan will not increase, but rental can if there is demand. So to generate the demand, we need all the 15 development areas to have a JMB each & work together!

Now is the time that we all unite for the future of BUTL. The Sri Jasmin story will reverberate across BUTL. Now is time that the whole of BUTL, 15 development areas strong, to participate and have a JMB each - that's 2 down, 13 more to go. Now you are probably wondering, why some has a bracket to the names like Sri Suria (Sena) while Sri Cendana is without bracket? The answer will required the dedicated person who would become office bearers of that development area to find out. What the For A Better BUTL team has done is a land search & what was stated in some of the Sale & Purchase Agreements says Sri Suria but the strata application states Sri Sena. Lot's of work to do? Plenty more when you start going. So please gather yourselves & start emailing us your "CV".

JMB For Sri Jasmin Soon

Some of you may not know this, COB (i.e. under MPN currently) for BUTL has appointed someone from the Resident Association of BUTL to convene the First Meeting of the JMB (Joint Management Body) for Sri Jasmin. You can read the letter at Sri Jasmin On JMB.

Some very important information that you all must know & remember is that unless and until an MC (Management Corporation) is formed, all of BUTL's individual developement areas (totaling 15) will have to form a JMB. Right now, some development areas have already applied the strata title & already approved but the developer has yet to subdivide them to the individual owners. For MC to be formed, you must have, within a development area, at least one-quarter (1/4) of the purchasers to have acquired the strata title.

Some people are saying that for the subdivision to occur, there are cost involved. Listen up ladies & gentlemen, read your SPA (sale & purchase agreement) and if the SPA states that your purchase of the apartment includes the strata title application then there is hardly any cost involved! But we have a dilemma. Our developer is under receivership & the receivers and managers kept saying they are only reponsible for the platinum damansara project. This issue is still being pursued by our team and in the mean time, JMB is the way to go.

If the JMB for Sri Jasmin is a success, then you bet the JMB for all the other 13 development areas will have a JMB as well. So all you people out there. Don't just sit there doing nothing, start reading up the Act 663 and start thinking how you can rescue your apartments. Without JMB, there is no way water can be paid. Neither Here Nor There

The last thing we want is to be in a cowboy town where neither bordering factions like to implement the law. Let's ponder these facts

  • We are not under the sole & absolute discretion of Dataran Mantin because they are under receivership.
  • The receivers & managers appointed said they are only responsible for the Platinum Damansara Project.
  • All except Sri Palma Villa Blocl 1, 2, 3 & 6 are left without management because the JMB was not formed.
  • Dataran Mantin has written to all that they are pulling out of the management of the place due to a lack of funds (or misappropriating, which ever you choose to believe..)
  • MPN is not going to take over the management of the place.
  • Neither is PwC, as they even place a sticker on DM's envelope stating that they are only the receivers & managers appointed for the Platinum Damansara Project (how convenient).

So while we are waiting for the JMB First Meeting, that is where we are currently at:

Borderless Zone

The last meeting with MPN was 22 Jul 2008 but until now, we are still waiting for DM's next move. That move is to provide a second round of JMB First Meeting which will start with 4 sites first. It should happen in the 2nd week of August but we are still waiting for their reply.


Now just because the 2nd Round of the JMB First Meeting is coming soon does not mean that the JMB will be formed! Yes, that is correct, correct, correct. Some had 3 rounds of the JMB First Meeting but the JMB still failed to form. So you can imagine how things are like in a borderless zone. Even if the 4 JMBs are formed next month, what about the rest of the 9 or so?

But in the mean time, we can't just sit there & wait for worse things to happen to BUTL. So to give the group a bit more bite, we are setting up a Residence Association (RA). That's right, we are taking up the fight with authority & with gusto. And you can be sure that you can have your say when this association is open for membership once it is registered.

The few things on top of the list to tackle are

  • Water - we need to sort out & make sure that all the sites have water.
  • Common Area lighting - right now, once the moonlight takes over, it's free for all, so if you are there at night, better be in a group, so we need to sort out the electricity issue.
  • Security - how ever we say that security in Malaysia is just a wave of a hand, we still need it. Without this, it is quite pointless to install flourescent lamp all over the common areas again.

So ladies & gentlemen, we know most of you don't want the property. Most of you are already fed up with this DM and all the briefings. But MOST of you are just waiting for a miracle to happen. So now is the time to rise up and be a select few. Be a representative for your site.

We are still open for registration. Those who have registered will be the first invited to be members of this RA. While that is on-going, we hope that every site will have some representatives. Write to us, forabetterbutl@gmail.com because whether you like it or not, we are in the same boat.

Documents to Authorities

Here are 2 documents that you should download, analyse & then contemplate if you want to join the cause. We cannot have 1 JMB or 1 MC but we will have at least 14 of such bodies. But the good news would be that all 14 can join forces & therefore reducing the cost of operation.

Do remember, however, for MC to form, you need at least one-quarter of the purchasers of that development area to have the strata title to their names. Problem now is, not many people understand the meaning of unity & all its repercussions otherwise. Rest assured, to get the parcel under your name in the strata title, DM will surely ask you to pay up all the outstanding fees. Another problem is that some of the DM staffs don't even know strata title has been applied & approved & still intends to form the JMBs, sigh..

No, it's not that we cannot form a single JMB for the 5-storey walk-ups.

No, it's not that Dataran Mantin is again up to their usual tricks of not wanting to be responsible anymore for BUTL.

No, it's the revelation that 11 out of 15 development area of BUTL of our interest already have a strata title!

So let's just show you what got our jaws elongated & fixated.

No need to describe what questions we asked them. Let's just get to the point, what's next.
0. Do a land search & get the exact data & it will be published here.
1. Firstly, we will give PTG (Pejabat Tanah & Galian) a letter asking them why has the developer has yet to submit strata title application for the 4 mentioned above, where it should be done in no more than 6 months after VP (Vacant Possession).
2. We will seek answers from (PwC) Pricewaterhouse Coopers Malaysia since DM (Dataran Mantin) has sort of washed their hands off this project.
3. Quickly call for sub-division to all owners of their individual parcels for those having strata title - i.e. initial a Memorandum of Transfer (for owners who wants to pay for it).
4. Quickly call for creation of a MC (Management Committee) for all those where 1/4 of the strata title has been Transfered.
5. Continue pursuit of JMB creation for the 3 without strata title & without JMB. Those development area that has a strata title but have not got 1/4 transfered will need a JMB first.

In the mean time, form a Resident Association - this will be the party that will act on various problems such as water !

Lot's of work & lot's of headaches. All those who are owners of parcels with strata title, we need your participation to become part of the MC. You cannot be quiet now.
